The United States government has the responsibility of ensuring the promises of the preamble, the promises are the following: perfecting the union, establishing justice, insuring domestic tranquility, providing for the common defense, promoting the general welfare, and securing the blessings of liberty and prosperity. The federal government must be held accountable for guaranteeing the promises stated by the founding fathers. A federal government divides its powers between a national government and small local governments. The United States', federal government fails to ensure the promises made within the preamble because the federal government threatens the well being of its individuals by exploiting their social contract through a biased justice system and the corruption of our president. Many of us would like to believe that we live in an honorable and fair country, but if we were to look into how criminals are prosecuted we would see right through the biased justice system that is run within the United States. Customarilycases an uncontrollable part of one’s identity, such as their race determines how they are convicted for a crime they have committed. “Blind charging” has been implemented in places such as San Francisco in order to determine whether or not prosecutors are biased. Blind charging is when prosecutors charge someone without having any knowledge of their race or name.

After conducting this experiment, “legal analysts said that the San Francisco policy” has led prosecutors to file charges against African Americans for low-level drug offenses more frequently than against whites, even though studies show white people use illicit drugs at higher rates” Justice isn’t being served equally throughout our system of government, it has been proven that white people are the highest users of drugs, yet people of color are the ones who bear the consequences the most. The color of one’s skin has been proven to be a fundamental factor when deciding someone's criminal’s sentence. It’s very hard to imagine that the leader that many people elected and believe to be honorable is someone that is far from it. John Locke’s theory of a social contract illuminates that in order for people to have security and safety must be willing to give up some of their own liberty and form a “social contract”. Kaine stated that “the well-being of American troops is the core responsibility of every commander in the military, yet the commander in the military, the commander in chief is shirking that duty so he can advance his own political agenda”. Providing for the common defense is one of the responsibilities of the United States government, the president has constantly violated the social contract of its citizens through his selfishness. He must provide for the common defense of his country, instead he tries to constantly take corrupt actions against his own people to benefit himself. Although the establishment of justice and providing for the common defense are two promises that have been compromised, one may argue that the government puts their best effort into perfecting its union. Laws have been passed in the past to make it illegal to discriminate against college applicants, such as the Civil Rights Act of 1964.

The article Affirmative Action and College Administrators, state that “affirmative action refers to the special consideration” of groups of people that have been historically excluded. Although the government has implemented affirmative action to unite people based on their differences, it has failed to realize that on its own it will make no difference if there are other sources of discrimination contributing to separation within the U.S., such as a biased justice system. In these more recent years we have seen over and over how the government fails to withhold its promise to its occupants. For example, it must provide protection for it’s occupants and we are no longer doing that. In this justice system we have seen movements such as “Black Lives Matter” but haven't really seen much of a change. We have seen over and over that race is a major factor in sentencing, when the criminal is white, we see how they just get a slap on the wrist so to say. We have seen that protection is being compromised because some people are not allowed to serve in the US military. All in all, these are the reasons The United States’ federal government fails to ensure the promises made within the preamble because the federal government threatens the well being of its individuals by taking advantage of their social contract through a biased justice system and the corruption of our president.
